Las Cruces council could condemn Rep. Herrell for electoral votes

LAS CRUCES – Less than a month after taking office, Las Cruces City Council will vote on the formal conviction of U.S. Representative Yvette Herrell, R-NM, for her vote not to certify the election results 2020 presidential election in two states.

Earlier this month, and hours after a deadly insurgency in the United States Capitol by rioters who mistakenly believed the election was stolen, Herrell voted against certification of President Joe Biden’s electoral victory Arizona and Pennsylvania, the only two states to receive member objections. of the Senate and the House of Representatives during the certification process.

Herrell argued that electoral practices in those states were unconstitutional and “disenfranchised” voters in New Mexico. The first-year congressman recognizes Biden as president and is committed to working with him to find common ground on political issues.

City council approval of a resolution condemning Herrell, which it will consider at its February 1 meeting, would be entirely ceremonial and has no other power. The text of the resolution underlines that the measure would be important to express the council’s support for democracy and democratic institutions.

Herrell told the Sun-News in an interview earlier this month that his votes were not an attempt to nullify the election in favor of former President Donald Trump and said: “Congress does not have the capacity to nullify elections . What we can do, however, is call attention to elections that have a constitutional question.

“It is the role of the judiciary, not Congress, to make decisions on constitutional matters, including the appropriate remedies for a constitutional violation if a court determines that a violation has taken place,” the resolution reads.

The resolution also argues that Herrell’s votes actually deprived the two states she refused to join in certification.

“By voting to deny voters in two of New Mexico’s sister states the right to vote, Representative Herrell has set a precedent that could be used by a future member of the House of Representatives to deny voters the right to vote in New Mexico. New Mexico and Las Cruces, ”the resolution reads.

“Representative Herrell’s votes contribute to the delegitimization of legal electoral dispute resolution processes, which profoundly undermines democratic values ​​and the internal tranquility of our country,” adds the resolution.

A spokesperson for Herrell’s office said the council’s action would constitute a breach of its most urgent duties.

“Why is Las Cruces City Council wasting time on this as an immigration and funding crisis looms thanks to the Biden administration’s actions to weaken border security and destroy more one-third of the annual income of the state of New Mexico? ” wrote a spokesperson.

“Instead of drafting meaningless resolutions,” the spokesperson continued, “the MP has so far introduced two bills to maintain critical health protections at the borders and save the industry and jobs that provide every year over billions of dollars in education funding for schools in New Mexico City council should follow the member’s lead and get to work to address the number of challenges facing their community. “
